When You Need a Workers Comp Lawyer...

The majority of Florida workers
compensation claims are relatively simple legal matters. For
example, you slip at work and break your arm. While your
pain can be considerable, the medical bills are relatively
minor and will be taken care of by your employer’s workers’
compensation insurance. Your doctor will determine when you
can return to work, and Florida Law dictates how much
compensation you are entitled to, and for what length of
time.
While it’s almost always true that you are better off in any
legal situation with a lawyer on your side, Florida Law was
partially written to keep court and legal costs low. For
example, Florida’s Division of Workers Compensation rules
seek to reduce the number of people who hire an attorney,
and place the burden of proof and legal fees on the
plaintiff if you lose your workers’ compensation case.
It is both practically and legally impossible to offer legal
advice on a web site because every workers compensation
claim in Florida is different. However, if your injuries are
relatively minor, you will miss little work, your employer
is cooperating, and the State of Florida has accepted your
claim, you’re unlikely to require the services of a workers’
compensation lawyer.
On the other hand, if you are very seriously injured, may
not be able to work in the foreseeable future, the Florida
Department of Workers Compensation is giving you problems,
or your employer is challenging your claim, your best
interests are likely served by hiring a lawyer.
The reality is that most workers compensation cases fall
somewhere in between these extremes. Florida employees have
some protection under State Law, but should contact a
competent Florida workers compensation lawyer as soon as
they begin to worry that they are not being dealt with
fairly.
