Florida’s Workers
Comp challenges
Florida certainly isn’t the only state to
write laws in an effort deal with the growing challenges
with the workers’ compensation system. Too often,
unscrupulous lawyers and questionable plaintiffs unfairly
burdened businesses with high legal and insurance costs. By
the same token, too many businesses and insurance companies
were leaving people, with legitimate workers’ compensation
claims, out in the cold.
Over the last 15 years, the State of Florida has continued
to make changes to the Workers Compensation System,
resulting in less benefit for the injured worker. First,
Florida businesses that are required to carry workers’
compensation insurance are held legally responsible for
safety in the workplace, and to care for people injured in
their offices, factories, or while on the roads.
Florida Law similarly imposes responsibilities and
limitations on the people injured in workplace accidents.
Those with workers’ compensation claims are required to file
claims within a set time period, and potential compensation
for lost wages are set. Limits are placed on the damages you
can receive unless malice or some type of serious negligence
can be legally proven.
Florida Law has written to make sure that Florida employers
carried insurance in order to take care any staff injured
while on the job, and that those receiving workers’
compensation payments were entitled to those benefits. The
attempt at balance between workers’ rights and business
interests has taken more money and benefits out of the hands
of the injured worker. The need to have representation
