One 10-minute visit to Florida's Division
of Workers' Compensation web site (http://www.fldfs.com/wc/)
will quickly convey how complicated Florida's laws truly
are. For example, the first notice (Feb 2008) is
entitled "Recommendations for Determining Customary Charges
for Florida Outpatient Hospital Services to Workers'
Compensation Patients." It gets much more complicated from
there.
Under the "Publications and Manuals" menu button, you will
find a brochure intended to explain victims' rights in
workers' compensation cases in Florida. It includes contact
numbers for appropriate offices, as well as some solid
information about your rights and responsibilities.
Unfortunately, it includes many somewhat confusing
sentences.
''…benefits are provided when the doctor releases you to
return to work and you have not reached MMI and earn less
than 80% of your pre-injury wage. The benefit is equal to
80% of the entire difference between 80% of your pre-injury
wage and your post-injury wage."
More troubling is this paragraph:
''You are not required to have an attorney. If you do hire an
attorney to represent you with your workers' compensation
claim, the fees and costs may come out of your benefits,
unless your employer or workers' compensation carrier is
held responsible for paying your attorney fees.''
The reality of Florida's Workers' Compensation laws is that
they are very complicated, always changing, and can be more
than a little intimidating. We obviously recommend that you
hire a lawyer who can guide you though the process, make
sure that you cross all the t's and do the i's, and preserve
your legal rights.
